These Terms of Service (“Terms”) govern access to and use of services provided by Growth Sector LLC d/b/a DataCloud Marketing.

By accessing or using our services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts.

2. Permitted Use

Data is provided strictly for lawful marketing, advertising, and business intelligence purposes.

You agree that you will NOT use data for:

  • Credit decisions
  • Employment screening
  • Insurance underwriting
  • Housing or tenant screening
  • Eligibility determinations
  • Any FCRA-regulated purpose
  • Any unlawful purpose

3. FCRA Representation

You represent and warrant that:

  • You are not a consumer reporting agency.
  • You will not use data as a consumer report.
  • You will not use data in any manner that would cause it to become subject to FCRA.

4. Compliance Responsibility

You are solely responsible for compliance with:

  • FCRA
  • CAN-SPAM
  • TCPA
  • CCPA/CPRA
  • GDPR
  • State privacy laws
  • Data broker regulations
  • Any other applicable laws

5. Data Accuracy Disclaimer

All data is provided “AS IS” and “AS AVAILABLE.”
We do not warrant accuracy, completeness, or fitness for a particular purpose.

6. Limitation of Liability

To the maximum extent permitted by law:

Growth Sector LLC shall not be liable for:

  • Indirect or consequential damages
  • Regulatory fines
  • Misuse of data
  • Compliance failures by client

Total liability shall not exceed the amount paid by Client in the preceding 12 months.

7. Indemnification

You agree to indemnify and hold harmless Growth Sector LLC from any claims, fines, damages, or liabilities arising from:

  • Your misuse of data
  • Regulatory violations
  • Breach of these Terms

8. Intellectual Property

All proprietary systems, enrichment methodologies, and platform materials remain the property of Growth Sector LLC.

9. Termination

We reserve the right to suspend or terminate access for violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

Venue shall be in courts located in New York.

11. Modifications

We may update these Terms at any time. Continued use constitutes acceptance.
